1. GENERAL AND SCOPE

1.1 Applicability and Scope

These General Terms and Conditions (GTC) govern the use of the services on osarus.3forone.auction, an exclusive offering by 3forONE AG, Obere Paulistr.13, CH-8834 Feusisberg, in technical partnership with OSARUS. These GTCs apply from the moment you register or use the platform.

1.2 Contractual Partner and Purchase Contracts

OSARUS is your contractual partner for the acquisition of horses through auctions. 3forONE AG acts as a technical service provider and intermediary.

1.3 Technical Realization

3forONE AG provides the technical infrastructure for conducting online and hybrid auctions.

 

2. SUBJECT MATTER OF PERFORMANCE

2.1 Technical Infrastructure

3forONE provides the technical infrastructure for conducting online and hybrid auctions. OSARUS is responsible for conducting the auctions and describing the horses.

2.2 Disclaimer of Liability

3forONE is not liable for damages arising from using the platform or related to the auctions unless such damages are caused intentionally or through gross negligence.

2.3 Technical Adjustments

The user is responsible for adjusting the technology required for platform usage at their own expense.

 

3. REGISTRATION AND USER ACCOUNT

3.1 Registration

Participation in auctions requires prior registration. Registration is done through a registration form provided by 3forONE.

3.2 Bidding History

Your user account includes information about your bidding history, which OSARUS can view.

3.3 Data Updates

Changes to the data provided during registration must be promptly updated in the user account.

 

4. PARTICIPATION IN AUCTIONS

4.1 Conclusion of Contract

A contract between the user and OSARUS is concluded upon successful participation in an auction.

4.2 Negative Reviews

Failure to fulfill payment obligations may result in a negative review for the user.

 

5. LIABILITY AND INDEMNIFICATION

 

5.1 Liability

3forONE is not responsible for any damages or losses arising from using the platform or related to the auctions.

5.2 Indemnification

The user indemnifies 3forONE from all claims by third parties if the user violates 3forONE's rights or any other rights.

 

6. COPYRIGHT AND DATABASE RIGHTS

6.1 Copyright Protection

The contents of the osarus.3forone.auction international copyright and database rights protect auction platform.

6.2 Prohibited Use

The user may not copy or reuse the platform's contents for commercial purposes without explicit written consent from 3forONE.

 

7. DURATION AND TERMINATION

7.1 Duration

The user agreement runs indefinitely.

7.2 Termination

The user can terminate the agreement at any time by deleting their account.

 

8. FINAL PROVISIONS

8.1 Amendments

3forONE reserves the right to amend these terms and conditions at any time.

8.2 Prohibition of Assignment

The user is not entitled to transfer their rights from the user agreement without the explicit written consent of 3forONE.

8.3 Applicable Law

These terms and conditions are subject to Swiss law.
