Terms and Conditions for the Osarus.Auction Platform
1. GENERAL INFORMATION AND SCOPE
1.1 Validity and Scope
These Terms and Conditions (T&Cs) govern the use of services on osarus.auction, a platform provided by 3forONE AG in technical partnership with Vente Osarus S.A.R.L.
The T&Cs become binding upon registration or use of the platform and apply to all users.
1.2 Contractual Partners and Purchase Agreements
Vente Osarus S.A.R.L. is your sole contractual partner for the purchase of horses through auctions.
3forONE AG acts exclusively as a technical service provider and intermediary, without participation in purchase contracts or the auction settlement process.
1.3 Technical Implementation
3forONE AG provides the technical infrastructure for conducting online and hybrid auctions and is responsible for the platform’s technical functionality.
2. SCOPE OF SERVICES
2.1 Technical Infrastructure
3forONE provides the technical infrastructure required for online and hybrid auctions.
Responsibility for the content, execution, and decisions regarding bidder participation or exclusion lies solely with Vente Osarus S.A.R.L.
3forONE acts as a technical service provider and assumes no responsibility or liability for any decisions related to the auction process, including the suspension or exclusion of users.
2.2 Disclaimer of Liability
3forONE excludes any liability for damages or losses arising from the use of the platform, unless caused intentionally or through gross negligence by 3forONE.
This specifically includes, but is not limited to, all decisions concerning suspensions, deletions, or exclusions of users, which are made exclusively by Vente Osarus S.A.R.L.
3forONE shall not be liable for financial, legal, or technical consequences arising from decisions made by Vente Osarus S.A.R.L. and assumes no responsibility for the content or legal framework of the auctions.
2.3 Technical Requirements
Users are responsible for ensuring that their own technical setup meets the requirements for using the platform.
3forONE shall not be held liable for any technical interruptions, delays, or disruptions resulting from the user’s technical environment or from external third parties.
2.4 Livestream and Delays
The livestream provided during auctions may be subject to technical delays depending on the user’s internet connection and device performance.
3forONE assumes no liability for delays or disruptions caused by individual internet connections or technical equipment.
Users are advised to place bids directly via the bidding interface, which operates in real time.
2.5 Bidding Recommendations
To avoid delays, users are advised to place bids directly through the platform’s bidding interface.
Due to technical factors, the livestream may experience slight time delays.
Bids placed solely on the basis of the livestream may not be registered in time as a result of such delays.
2.6 Time Coordination and External Influencing Factors
The timing of all auction processes is governed by a centrally managed internal time reference of the platform, which is solely authoritative for determining the beginning, progression and conclusion of bidding phases.
Time indications or displays on users’ devices may differ from this internal time reference due to individual settings, technical processes or external factors. Such deviations lie outside the responsibility of 3forONE AG and have no effect on the actual execution of the auction.
A bid is valid only if it is fully received and registered by the systems of 3forONE AG within the relevant time frame. Users are responsible for ensuring the proper functioning of their own technical environment.
3forONE AG accepts no liability for delays, inaccurate displays or any disadvantages arising from local time deviations, external influences or technical conditions beyond our control. The platform is operated with due care and in accordance with recognised operational standards; however, external factors cannot be fully excluded.
3. REGISTRATION AND USER ACCOUNT
3.1 Registration
Participation in auctions requires prior registration.
Registration takes place through a form provided by 3forONE.
The decision to activate or suspend a user account lies solely with Vente Osarus S.A.R.L.
3.2 Bid History and Data Access
During your participation in auctions via the platform, data related to your bidding activity will be processed.
This includes information on bids placed, successful highest bids, and the timeline of your bidding activity.
This information will be:

communicated to you via e-mail, e.g. when placing a bid, when you are the highest bidder, or when you have successfully purchased a lot. Vente Osarus S.A.R.L. will then contact you directly to handle the post-auction process.

displayed anonymously during a live auction on the front end:
– for online bids, with the bidder’s country flag,
– for on-site bids, marked as “Salle” (without a flag).
No disclosure of names or personal data will occur.
Data is processed by 3forONE as part of platform operation and may be used for purposes of auction processing, security, quality assurance, and system improvement.
The legal basis for such processing is Article 6(1)(b) and (f) GDPR (performance of contract and legitimate interest).
3.3 Data Updates
Users must promptly update any changes to their registration data in their user account.
3forONE AG shall not be held responsible for any disadvantages arising from outdated or incorrect information.
3.4 Responsibility for Accuracy
Users are responsible for ensuring that all information provided during registration and use of the platform is correct and complete.
3forONE AG shall not be liable for any damages or losses resulting from incorrect or incomplete information.
If it is determined that a user has provided false information, 3forONE reserves the right to immediately suspend or delete the respective account.
4. PARTICIPATION IN AUCTIONS
4.1 Conclusion of Contract
Upon successful participation in an auction, a contract is formed exclusively between the user and Vente Osarus S.A.R.L.
3forONE AG is not a contracting party and assumes no responsibility or liability for these agreements.
4.2 Auction Rules and Participation Conditions
Vente Osarus S.A.R.L. sets the rules and conditions for participation in auctions, including the right to exclude users from participation.
3forONE AG has no influence over these decisions and assumes no liability for them.
4.3 Placing Bids
Before placing a bid, users are required to verify the amount displayed in the bidding interface.
By clicking “Place Bid,” the bid becomes binding.
Once submitted, a bid cannot be withdrawn or modified.
4.4 Authority of the Auctioneer and Handling of Online Bids
The conduct of the auction and all decisions regarding the acceptance, prioritisation, evaluation or rejection of bids lie exclusively with the auctioneer or the authorised personnel acting on site.
The platform implements these decisions technically and has no influence on their content or formation.
This includes, in particular, the authority to prioritise floor bids over online bids and to reset, remove or disregard online bids upon instruction of the auctioneer or authorised personnel— even where the system may previously have issued automatic notifications such as confirmations or highest-bidder messages.
Such system notifications are for information purposes only and do not constitute any binding entitlement to recognition, consideration or award of a bid.
Users have no claim to the acceptance or evaluation of any online bid if the auctioneer makes a differing decision.
All liability of the platform operator for the rejection, non-consideration, deletion or invalidation of online bids is excluded.
5. LIABILITY AND INDEMNIFICATION
5.1 Liability of 3forONE AG
3forONE AG’s liability is limited to intentional or grossly negligent conduct.
Further liability, in particular for slight negligence, consequential damages, or loss of profit, is excluded.
5.2 Disclaimer Regarding Auction Decisions
3forONE AG is not liable for any acts or omissions of Vente Osarus S.A.R.L., especially concerning decisions about user suspensions or exclusions, auction design, or contract fulfillment.
5.3 Indemnification
The user agrees to indemnify and hold 3forONE AG harmless from all third-party claims arising from unlawful or improper use of the platform.
6. COPYRIGHT AND DATABASE RIGHTS
6.1 Copyright Protection
The contents of the platform are protected by copyright and database rights.
All rights belong to 3forONE AG or the respective rights holders.
6.2 Use of Content
Use of platform content is permitted only for its intended purpose.
Reproduction, distribution, or any other use is prohibited without the prior written consent of 3forONE AG.
7. TERM AND TERMINATION
7.1 Term
The user agreement is concluded for an indefinite period and may be terminated by either party at any time unless otherwise agreed.
7.2 Termination by the User
Users may delete their account at any time.
Existing obligations towards Vente Osarus S.A.R.L. remain unaffected.
7.3 Termination by 3forONE AG
3forONE AG reserves the right to terminate the user relationship without notice if the user violates these T&Cs or misuses the platform.
8. FINAL PROVISIONS
8.1 Amendments to the T&Cs
3forONE AG reserves the right to amend these T&Cs at any time with future effect.
Changes will be communicated to users via e-mail or upon their next login.
If the user does not object within two weeks, the changes are considered accepted.
8.2 Assignment Restriction
Users may not transfer rights or obligations under this user agreement to third parties without the prior written consent of 3forONE AG.
8.3 Applicable Law and Jurisdiction
Swiss law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Where legally permissible, the place of jurisdiction shall be the registered office of 3forONE AG in Feusisberg, Switzerland.
8.4 Validity of the Current Version
Only the most recent version of these Terms and Conditions shall apply.
Upon publication of a new version, previous versions lose their validity.
8.5 Data Protection
3forONE AG processes personal data exclusively in compliance with applicable data protection laws.
